In accordance with the Law of Ukraine “On basic principles and requirements for the safety and quality of food products” dated December 23, 1997 No. 771/97-ВР (6) (hereinafter – the “Law”), a dietary supplement is a food product consumed in small certain quantities additionally to a regular food ration, which is a concentrated source of nutrients, including proteins, fats, carbohydrates, vitamins, minerals (this list is not exclusive), and is made in the form of tablets, capsules, dragees, powders, liquids or other forms. In accordance with the legislation of Ukraine, a biologically active additive is considered a dietary supplement, that is, a food product made in the form of tablets, capsules, dragees, powders, liquids or other forms.
With regard to the possibility of returning a dietary supplement, for example to a pharmacy, provided that this product has not been unpacked and has not yet passed 14 days from the date of purchase, the following should be noted:
The Cabinet of Ministers of Ukraine approved the Resolution on the Implementation of Certain Provisions of the Law of Ukraine “On Protection of Consumer Rights” dated March 19, 1994 No. 172 (7) (hereinafter referred to as the “Resolution”), which approved the List of goods of good quality that cannot be exchanged (returned).
Thus, in accordance with the provisions of this Resolution, food products, medicines and products, hygiene items are not subject to exchange (return).
Thus, the person who purchased the dietary supplement can return it to the pharmacy only if the product is unfit for consumption (contains foreign substances and/or objects, damaged in another way and/or spoiled as a result of mechanical and/or chemical, and/or microbial factors).
